Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the ASR Luxury website at asrluxury.com (the “Site”) and all services we provide, including exotic and luxury car rentals, yacht charters, private jet charters, luxury home rentals, chauffeur services, consignment, partner programs, and any related concierge services (collectively, the “Services”).

By using the Site, requesting a quote, making a reservation, or otherwise engaging with our Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or our Services.

1. Definitions

  • “ASR Luxury,” “we,” “us,” or “our” refers to the legal entity operating ASR Luxury at the address in Section 16.
  • “Customer,” “you,” or “your” refers to the individual or entity accessing the Site or engaging the Services.
  • “Vehicle” refers to any car, yacht, jet, home, or other asset made available by ASR Luxury for rental or charter.
  • “Reservation” means a confirmed booking of a Vehicle for a defined period.

2. Eligibility

To rent a vehicle from ASR Luxury, you must:

  • Be at least 18 years of age.
  • Hold a valid government-issued driver’s license. International renters must present a valid passport and, if applicable, an International Driving Permit.
  • Carry valid auto insurance with coverage that extends to rental vehicles. ASR Luxury does not provide auto insurance to renters.
  • Provide a major credit card in your name for the security deposit and any incidental charges.
  • Pass any reasonable identity, license, and credit verification we conduct as part of confirming the reservation.

Yacht and jet charters are subject to additional eligibility requirements imposed by our charter partners and applicable maritime / aviation regulations. Home rentals require all guests to be disclosed at booking and may require proof of identity at check-in.

3. Reservations and Quotes

All pricing on the Site is illustrative only. Final pricing is provided in a written quote from our concierge team and depends on the specific Vehicle, dates, length of rental, season, and any add-on services. Pricing is on request.

A Reservation is not confirmed until you receive a written confirmation from ASR Luxury (by email or in writing) and have paid any required deposit. We reserve the right to decline or cancel a Reservation in our sole discretion before delivery.

4. Payment, Deposits, and Fees

  • Rental fees: the rental fee for the agreed period is due before delivery unless otherwise agreed in writing.
  • Security deposit: a refundable security deposit is held on a major credit card at delivery. The amount varies by Vehicle and is communicated in your written confirmation. The deposit is released after the Vehicle is returned and inspected.
  • Incidental charges: we may charge your card for fuel, mileage overage, tolls, parking citations, traffic violations, cleaning fees, and any damage caused during your rental. We will provide an itemized statement.
  • Taxes and surcharges: applicable sales tax, airport surcharges, and licensing surcharges are added to the rental fee as required by law.
  • Payment processing: card payments are processed by a PCI-compliant third-party payment processor. We do not store full card numbers on our servers.

5. Cancellation and Modification

Cancellation terms vary by Reservation and are specified in your written confirmation. Event-specific bookings (weddings, proms, music videos, festivals such as Coachella) and high-demand windows (awards season, holidays, F1 race weeks) typically have stricter terms.

Modifications to the Vehicle, dates, or delivery location are subject to availability and may result in a price adjustment.

6. Vehicle Use and Restrictions

You agree to operate the Vehicle in compliance with all applicable laws and:

  • Use the Vehicle only for lawful, personal, non-commercial purposes unless we have agreed in writing (e.g., music video, film, or commercial production).
  • Not allow any person other than the named driver(s) on the rental contract to operate the Vehicle.
  • Not use the Vehicle for racing, off-roading, towing, transporting hazardous materials, or any unlawful activity (including driving under the influence).
  • Not modify the Vehicle, place stickers or wraps on the Vehicle, or carry out repairs without our written consent.
  • Not smoke or allow smoking, vaping, or pets in the Vehicle except where we have explicitly agreed in writing.
  • Not transport more passengers than the Vehicle’s seating capacity.
  • Return the Vehicle by the agreed date and time, in the same condition received, with the same fuel level. Late returns are billed at the daily rate plus a late fee.

Geographic restrictions: Vehicles are not permitted to leave the United States. Travel to Las Vegas, Palm Springs, San Diego, and other in-state destinations is generally allowed with prior written approval. International travel (Mexico, Canada) is prohibited on standard rentals.

7. Insurance and Liability

You are responsible for any damage, loss, or theft of the Vehicle during the rental period, regardless of fault, except where prohibited by law. ASR Luxury does not provide collision damage waiver or supplemental liability insurance to renters; you must carry your own valid auto insurance with coverage that extends to rental vehicles. We will require proof of coverage at delivery.

Many premium credit cards (American Express Platinum, Chase Sapphire Reserve, etc.) extend rental coverage to exotic vehicles when you pay the rental with that card and decline the rental company’s collision damage waiver. Verify the specific coverage terms with your card issuer before relying on this option.

You are responsible for any traffic violations, parking citations, tolls, and related fines incurred during the rental period.

8. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless ASR Luxury, its owners, employees, agents, contractors, and partners from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your use of the Vehicle or the Services;
  • your breach of these Terms;
  • your violation of any applicable law or the rights of any third party; or
  • any negligent, reckless, or intentional act or omission by you or anyone you allow to operate the Vehicle.

9. Limitation of Liability

To the maximum extent permitted by law, ASR Luxury, its owners, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Site or the Services, including loss of profits, loss of data, or business interruption, even if we have been advised of the possibility of such damages.

Our total cumulative liability arising out of or related to the Services or these Terms shall not exceed the total amount you paid to ASR Luxury for the specific Reservation giving rise to the claim, or one thousand US dollars ($1,000), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages; these limitations apply only to the extent permitted by law.

10. Yacht, Jet, and Home Rental Specifics

Yacht charters, private jet charters, and luxury home rentals are arranged through third-party operators or property owners and are subject to those operators’ additional terms, which we will provide before booking. Maritime and aviation safety rules, captain’s/pilot’s discretion, weather restrictions, and property-specific house rules apply. Cancellations and force-majeure events are governed by the underlying operator’s terms.

11. Chauffeur Service

Our chauffeur services are provided by professional drivers we contract or employ. The chauffeur retains operational control of the vehicle and may decline routes or stops that present safety, legal, or liability concerns. Customers are responsible for the conduct of all passengers in their party.

12. Intellectual Property

All content on the Site, including text, photographs, video, logos, and the “ASR Luxury” brand, is the property of ASR Luxury or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent, except that you may share links to public Site pages on social media in the ordinary course.

13. Site Use and User Conduct

You agree not to:

  • access the Site by any automated means (bots, scrapers, harvesters) except as expressly permitted by our robots.txt or under a written agreement;
  • interfere with the Site’s operation or security, or attempt to access any non-public area;
  • impersonate any person or entity, or misrepresent your affiliation;
  • submit false, misleading, or fraudulent content through the Site, our forms, or our communications channels;
  • use the Site or Services for any unlawful purpose.

14. Termination

We may suspend or terminate your access to the Site or the Services at any time, with or without notice, for any reason, including breach of these Terms. Sections that by their nature should survive termination (Sections 7–9, 12, 15, and 16) will survive.

15. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to them or the Services are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

Informal resolution. Before filing a claim, you agree to first contact us at hello@asrluxury.com and attempt to resolve the dispute in good faith for at least sixty (60) days.

Binding arbitration.Any dispute that cannot be resolved informally shall be resolved by binding arbitration administered by JAMS under its Comprehensive Arbitration Rules and Procedures, conducted in Los Angeles County, California, before a single arbitrator. Each party bears its own attorneys’ fees and costs except as required by law.

Class action waiver. Disputes shall be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding, except where prohibited by law.

Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction in Los Angeles County, California to protect its intellectual property rights or enforce a non-disclosure obligation.

16. Modifications

We may update these Terms from time to time. The current version is always available at asrluxury.com/terms. Material changes will be highlighted on the Site or, where required, communicated by email to active customers. Continued use of the Services after a change indicates acceptance of the revised Terms.
